TERMS AND CONDITIONS

Sia Lucky like, registration No. 50203600661, registered address: Zirņu iela 9a-6, Liepāja, LV-3401, hereinafter referred to as the online store, provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General provisions

If a consumer purchases goods/services through the website, this mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, the Regulations on Distance Contracts of the Cabinet of Ministers of the Republic of Latvia, etc.

2. Making purchases

The prices and specifications of the products sold in the online store are indicated next to the products.

The Customer places an order for Goods by adding the desired Goods to the “Shopping Cart” and completing the required fields on the website (including first name, last name, address, telephone number, email, payment and delivery method, and agreeing to the online store's terms of use).  Complete all required fields and choose the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Pay for your purchase to complete the order.

3. Payment terms

The payment currency on the website is the euro. Purchases can be paid for by choosing the following payment methods provided by the Every-pay payment platform. We accept VISA (including Visa Electron) and MasterCard debit and credit cards.

NB! When using the online banking payment method, confirm your order and click the “Return to merchant” button.

Personal data required to make payments is transferred to the licensed payment institution Every-pay.

The Contract takes effect upon successful payment into the online store's bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receipt of the notification.

4. Delivery terms

 Goods are delivered within Latvia. Purchased goods are delivered using Omniva parcel lockers, or can be collected on site at Ķieģeļu iela 36/38, Liepāja, LV-3401, Latvia. Delivery costs are displayed before the order is confirmed. Purchased goods are delivered within 3-5 business days.

5. Right of withdrawal

The Buyer has the right to withdraw from the purchase of the Goods within 14 calendar days of receiving them. To exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are used improperly or damaged due to careless handling during use or failure to follow the instructions, if the original packaging has been lost, or if the packaging is significantly damaged, the online store has the right to reduce the refund amount in proportion to the reduction in the value of the goods.

  • The recipient (Seller's name, physical address, telephone number, email address)
  • "I hereby give notice that I wish to withdraw from the purchase of the following Goods"
  • Order date/receipt date
  • Consumer's first and last name
  • Consumer's address
  • Date

Within 14 days of receiving the goods. The Buyer bears the cost of returning the goods, except where the reason for the return is that the goods do not match the order (for example, an incorrect or damaged product). The Buyer must return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will refund all payments received from the Buyer under the Distance Contract without delay, but no later than within 14 days.

The Seller has the right to withhold the refund until it has received the Goods from the Buyer or proof that the goods have been returned. If the Buyer has chosen a delivery method other than the cheapest delivery method offered by the online store, the online store is not obliged to reimburse the additional delivery costs.

The online store is not liable for any delay in fulfilling its obligations, failure to fulfil them, or any other non-performance caused by circumstances and obstacles beyond the online store's reasonable control.

The online store reserves the right to refuse to sell goods and to request the return of goods from the Buyer if the price displayed in the online store is significantly lower than their market price due to an error.

6. Processing of the Buyer's personal data

The online store processes only the personal data entered by the Buyer when ordering goods, such as first name, last name, email, etc.

The online store transfers personal data to the transport service provider(s) to ensure delivery of the goods.

If you have expressly consented to receive our marketing communications, including news, we may contact you from time to time with information about our services and latest offers. For this purpose, we may process the email address you provided when signing up for marketing communications. The Buyer may opt out of marketing communications by notifying us at [email protected]

7. Dispute resolution procedure

For matters not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The Parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If a dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve it in a court of the Republic of Latvia in accordance with Latvian laws and regulations. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to contact European Union dispute resolution bodies.
